Data Protection Notice
TALENT SELECTION, with offices at Koningin Astridlaan 35, 3500 Hasselt, attaches great importance to the secure and transparent collection and processing of your personal data. To ensure that you continue entrusting us with your personal data, we respect the applicable privacy and data protection legislation[1] and act in compliance with the Global Data Protection Regulation’[2].
This Data Protection Notice is intended to inform you about the collection and processing of your personal data. The new European privacy regulation, or GDPR, also applies to potential employees.
By using our website, you accept this Privacy Policy. And by divulging your personal data, you expressly declare that you have inspected this Data Protection Notice and agree to it, and to the processing itself.
1. Personal Data
Personal data means any information relating to an ‘identified or identifiable’ natural person. Therefore, this legislation does not apply to the data of legal persons. A natural person is regarded as ‘identifiable’, if he can be identified, directly or indirectly, in particular by reference to one or more factors specific to the physical, mental, economic, cultural or social identity of the natural person in question.
2. Services and Processing Purposes
When you use our services, you pass on to us specific personal data, depending on your activities. (Your identity and contact details.) You may also send us your CV, which contains additional specific data (such as education and work history).
Please be aware that you are responsible for all data which you provide us, and that we rely on it being accurate.
TALENT SELECTION always processes your personal data in a proportionate manner, only processing data which is necessary, relevant and limited to the achievement of the intended aim. This means, amongst others:
• We use the data obtained from you as a means of communication for performing tasks of recruitment, selection or assessment.
• We use the data during performance of our tasks and services, more specifically for the recruitment and selection of potential employees.
• Entering into contracts with you or your company (for employers).
According to the applicable legislation, this processing of personal data is justified on the basis of:
• consent given by you, for one or more specific purposes
• the public nature of this data
• the strict necessity of fulfilling and respecting our contractual and/or legal obligations
• protection of the legal interests of TALENT SELECTION and/or yourself, including ensuring the continuity of our activities
• other legitimate interests, including the implementation of our General Terms and Conditions
3. Retention Period for Personal Data
We store and process personal data no longer than necessary for achieving the intended aim. We only store data in the context of concrete job vacancies or tasks of recruitment and selection. In compliance with the above, and unless specific, legal limitation or retention periods require a longer period, the personal data which we process in the context of our services shall be retained for a period of 10 years from the end of our collaboration.
4. Sharing of Personal Data with Third Parties
In certain cases, the personal data collected will be passed on to a third party, such as, for example, the company which instructs us to post a specific job vacancy, for which you applied, or vice versa. We only permit this provided this is necessary for the realization of our task, and provided we are legally obliged to do this, if we are involved in a (legal) dispute or lawsuit.
We will never sell your personal data or make it available to third parties, unless you consent to this or we are required by law to do this. Only anonymous data will be used for statistics and improving our services.
5. Security of Personal Data
We take the necessary technical and organisational measures to protect your personal data and privacy. Thus, we use appropriate security technologies and set up the necessary internal processes and procedures to provide appropriate protection for your personal data. In addition, our employees are carefully selected and trained to handle confidential personal data in the correct manner, and are obliged by contract to respect confidentiality. Wherever reasonably possible, we ensure that access to your personal data is limited to persons who need it in order to perform their tasks, or to that which is necessary for performing and respecting our contractual and/or legal obligations. If a data leak or data breach occurs, we will notify you of this in person, in compliance with the applicable legislation and in the circumstances laid down by law.
6. Your Rights
The applicable legislation grants natural persons a number of rights relating to the processing of personal data:
• right of access
• right to rectification or correction of incorrect personal data
• right to erasure of data (right to be forgotten)
• right to restrict processing
• right to portability of personal data
• right to object to automated individual decision making and profiling
You can exercise the above rights by contacting TALENT SELECTION, via the email address: info@talentselection.be.
To provide certainty concerning your identity, this email must be accompanied by a copy of your identity card (proof of identity). We will do our utmost to handle your data in a careful and lawful manner, in compliance with the applicable regulations. In addition, you have the right, at any time, to withdraw your consent for the processing of your personal data. However, this withdrawal can never affect the lawfulness of processing which was based on the consent given at a time prior to its withdrawal. In addition, you have the right to file a complaint with the Data Protection Authority (Gegevensbeschermingsautoriteit) (contact@apd-gba.be, www.gegevensbeschermingsautoriteit.be).
7. Changes and Updates
